Breaking Down the Barriers: What’s Stopping Stronger Tobacco Control in Our Communities?
At Tobacco Free York County, we believe everyone deserves to live, work, and play in a healthy, smoke-free environment. But did you know that local efforts to control tobacco sales and protect youth are often restricted by state law?
Let’s break down some of the key legal barriers to tobacco control in South Carolina—and what we can do to push back.
1. State Preemption Gets in the Way
South Carolina’s Clean Indoor Air Act includes a law (§44-95-45) that blocks cities and counties from creating their own rules on things like:
- The flavors or ingredients in tobacco and vape products
- Special licenses for tobacco retailers
- Sales of nicotine products like cigarettes and e-cigarettes
This means even if our local community wants to pass stronger protections—like banning flavored tobacco near schools—we legally can’t. The state law overrides us.
2. Industry Lobbying Keeps It That Way
Tobacco and vape companies have a long history of pushing for state-level control because it's easier for them to manage one set of rules. If every city had the power to pass its own restrictions, they'd face a lot more accountability. That’s why these industries spend big money influencing lawmakers to keep local hands tied.
3. Limited Local Power
While we can enforce smoke-free zones in public spaces like parks and government buildings, we can’t:
- Require local licenses for selling tobacco
- Add stronger youth access laws beyond state minimums
- Charge local taxes on tobacco products
This weakens our ability to customize tobacco prevention strategies that fit our community’s unique needs.
What Can We Do?
Even with these barriers, there are still smart ways to protect our communities:
1. Strengthen Smoke-Free Spaces
Local governments still have the power to make public areas like parks, schools, and buildings smoke-free. These policies reduce exposure to secondhand smoke and create healthier environments for families and youth.
2. Educate and Empower the Community
Public support is powerful. Through community outreach, youth programs, and public education campaigns, we can raise awareness about the dangers of tobacco and build momentum for change.
3. Advocate at the State Level
Partnering with our state legislators is key. We can share community stories, data, and support to encourage lawmakers to change preemption laws and return more control to local governments.
4. Stay Alert and Informed
Legal landscapes change. By monitoring court decisions and statewide initiatives, we stay ready to act when opportunities arise.
